Privacy statement 

Van Bossé Business & Legal Solutions (“VBBLS”) respects your privacy and handles the personal data provided to or obtained by VBBLS with due care. Under the European General Data Protection Regulation (“GDPR”) personal data are any information relating to an identified or identifiable private person. Any information that could be related to a private person indirectly, is also considered as personal data. This statement describes how personal data is used and shared and what your rights as data subject are regarding your personal data. 

Data controller 

VBBLS qualifies as a data controller in accordance with the GDPR. VBBLS processes personal data to offer its services requested by you, to continuously improve the quality of its services and to be able to communicate and maintain a relationship with its clients. 

Purpose of processing personal data 

VBBLS processes the following personal data exclusively for the purpose of: 
(a) providing (legal) services to you or the organisation you are affiliated with, to perform its obligations under agreements (whether or not with its clients), including advice and to conduct (legal) proceedings;
(b) sending and collecting invoices; 
(c) advice, mediation and referral; 
(d) complying with legal and statutory obligations; 
(e) (commercial) communication.

Which personal data does VBBLS process? 

The personal data VBBLS may collect and process may include: 
(a) name, title, position within your organisation and the organisation for which you work;
(b) contact details such as your address, e-mail address and phone number; 
(d) personal data provided in the context or in the course of providing the services
(e) data related to the case(s) VBBLS handles for you; 
(f)  data related to your visit to the website; 
(g) personal data you provide to us for the purpose of attending events or meetings; 
(h) information required for processing invoice; 
(i)  personal data obtained from public sources and registers such as the trade register of the Chamber of Commerce (
Kamer van Koophandel);
(j) other data that you may provide during the course of any engagement.

The personal data mentioned above is used because it has been or will be provided by you on your own initiative, has been obtained in the context of the services provided by you, provided by third parties, including counterparties, or have become known through public sources. This data is required to be able to provide the services.

The legal grounds for the processing of personal data 

VBBLS processes the aforementioned personal data on one or more of the following legal grounds as referred to in article 6 of the GDPR:
(a) compliance with a legal obligation; 
(b) performance of a contract; 
(c) consent obtained from the relevant data subject(s); 
(d) legitimate business interest.

Sharing personal data with third parties 

VBBLS may share your personal data with third parties if this is necessary for the proper performance of its services and for the aforementioned purposes. For example, VBBLS may share your data with another expert engaged to handle your matter or in order to obtain an expert opinion, or if VBBLS engages a third party to provide services to VBBLS, such as an IT provider. VBBLS may also (be required to) provide your personal data in the context of any judicial or other legal proceedings or in relation to correspondence with the opposing party. 

VBBLS may also provide personal data with governmental bodies, such as a supervisory authorities or legal or governmental bodies, insofar as there is a legal obligation to do so. 

If VBBLS instructs a third party to process certain personal data on its behalf, VBBLS will conclude a data processing agreement with such party to ensure compliance with the GDPR. Third parties engaged by VBBLS who offer services as a controller (such as accountants, civil law notaries or an expert engaged to provide a second opinion) are themselves responsible for the (further) processing of your personal data in accordance with the GDPR.

VBBLS will only transfer personal data outside of the European region:
(a) where the transfer is to a country or other territory which has been assessed by the European Commission as ensuring an adequate level of protection of personal data; 
(b) with your consent; or 
(c) on the basis that the transfer is compliant with the GDPR and other applicable laws.

Data security 

As the security and protection of your personal data is of importance to VBBLS, VBBLS has implemented appropriate technical and organisational measures – taking into account the state of the art – to ensure an appropriate level of security to mitigate risks. To the extent VBBLS engages third party services for the provision of its services it has or will require such third parties to agree on arrangements regarding adequate security measures in the context of the protection of personal data.

Retention period 

VBBLS does not store your personal data longer than is necessary to fulfil the purpose for which it was collected, or to comply with any legal, regulatory or reporting obligations or to assert or defend against legal claims.

Your rights 

As a data subject you have a number of legal rights. 
You have the right to request VBBLS to: 
(a)  update, correct or complete inaccurate personal data; 
(b)  to stop processing your personal data;
(c)  object to the use of your personal data;
(d)  provide you with a copy of your personal data held by VBBLS; 
(e)  delete your personal data; 
(f)   restrict the use of your personal data; and/or 
(g)  provide you with a copy to be ported to an alternate provider.

Please note that there may be circumstances in which VBBLS is legally entitled to refuse your request, for example in order to observe the statutory retention period or to comply with statutory duties. 

Use of social media 

On VBBLS’ website you will find buttons and links to promote or share the website on social media platforms of third parties such as LinkedIn. VBBLS has no control over nor is it responsible for the processing of your personal data by and via those third parties nor over/for the use and storage of cookies by those third parties. The use of those media is for your own risk and account. Please read the privacy statements of those third parties before using their services. 

Statistics and cookies 

VBBLS keeps record of usage data of its website for statistical purposes. The data obtained are in principle anonymous and will not be provided or sold to third parties. 

To increase the user experience and accessibility of the website, VBBLS uses cookies on its website. A cookie is a simple text file that is stored on your device by a web browser. They are typically used to keep track of the settings users have selected and actions they have taken on a site. You may refuse the use of cookies by selecting the appropriate settings on your browser. Please note that this may affect the functionality and the ease of use of the website.

Amendments 

VBBLS may amend, supplement or restate this privacy statement at all times without prior notice. Amendments, supplements or restatements will be published on the website.
